Data Act – draft implementing law in preparation
On 11 August 2025, the Council of Ministers announced the start of work on a draft law on fair access to and use of data. What should you know?

Implementation of the Data Act
The aim of the draft law is the full implementation of Regulation (EU) 2023/2854 of the European Parliament and of the Council – the so-called Data Act – which will enter into force on 12 September 2025.
European data governance system
The Data Act introduces a framework for data sharing between businesses, between businesses and consumers, and between businesses and public authorities, creating a European system of data exchange and governance.
Need for national legislation
Although the Data Act will apply directly in Poland, certain matters left to the discretion of Member States require regulation at the national level.
Scope of the draft law
Issues to be addressed include: national procedural frameworks for applying the Data Act, penalties for infringements and the procedure for imposing them, as well as the designation of the President of UKE (Office of Electronic Communications) as the authority responsible for enforcement.
Stage of work
Adoption of the draft by the Council of Ministers is planned for the fourth quarter of 2025.
