MiCA regulation: RTS publication

The European Commission has adopted the RTS on the information required for an ART public offering authorization application. What must the application include?

Program of activities

The application must include a program of activities outlining the issuer’s business model, strategy, and risk assessment for three years from the date of authorization.

Information on organizational structure

The application should provide clear information on the issuer’s organization, operational structure, and governance rules. This includes, among others, the organizational chart and the number and profile of employees.

Internal control and required policies

The issuer should describe its internal control framework and indicate the responsible unit. It will also be necessary to attach policies on ART stabilization, the establishment, structure, and management of the reserve of assets, and the rules for their safekeeping.

Information on managing persons

The RTS also require information on the issuer’s management (including personal details, CVs, professional background, and criminal records).

Application template and next steps

The RTS comprehensively describe the requirements the application must meet. The regulations also include a template application form. The rules will enter into force on 5 October 2025.
