If you choose to contact us via the contact form available on our website or using our email addresses, telephone numbers, social media accounts or traditionally by mail or in person, and in situations where we have the right to contact you (e.g. for marketing purposes when you have given your consent, we have established a business relationship with you, or you have made a request to us to contact you about a particular matter), we will process personal data that you provide to us or that is necessary for us to respond to your inquiry (including identification and contact data, as well as your IP address if you use the contact form on our website), or that we have in connection with the relationship between us or that we have collected from publicly available sources. We process this data:

  1. because they are necessary for the purposes of legitimate interests pursued by us, i.e. in particular:
    • in order to respond to the message sent to us and to further contact you,
    • in order to respond to your request to get in touch with you on a specific matter,

  2. We will process your personal data that we obtain for the following purposes:
    • sending you our Newsletter,
    • archiving purposes to the extent necessary to comply with legal obligations,
    • claiming and defending against claims before and outside the courts and administrative bodies.
  3. We will process your personal data based on the necessity of the processing for the conclusion and performance of the contract (Article 6(1)(b) GDPR) and our legitimate interest as a personal data controller (Article 6(1)(f) GDPR).
  4. Provision of personal data is a condition for the conclusion of the Newsletter contract. The consequence of failure to provide the required data will be the inability to subscribe to our Newsletter.

DATA PROCESSED IN CONNECTION WITH APPLICATIONS FOR POSITIONS OR STUDENT INTERNSHIP PROGRAMMES – SCOPE OF PROCESSING

  1. Within the KWKR website, you can apply for our current job or co-op offers, as well as apply for our student internship program.
  2. As part of the recruitment process, we will process such data as your name, surname, date of birth, contact details, education, previous employment history, professional qualifications, as well as other data that you include in your resume or provide to the Data Controller during the recruitment process. If you apply to a student internship program, we will also process the result of your placement test..
  3. We will process your data for the following purposes:
    • Carrying out the recruitment process in which you participate:
      • – in the case where the job advertisement concerns employment under an employment contract: on the basis of necessity for the performance of a legal obligation incumbent on KWKR (Article 221 §1 of the Labor Code), with regard to the following data: first and last name, first names of parents, date of birth, place of residence, education, course of previous employment, professional qualifications;
      • – in the case where the advertisement concerns cooperation on the basis of a commission or other civil law contract and a student internship program, or in the scope of other data than those indicated above: on the basis of your consent to the processing of personal data (expressed through your declaration or a clear affirmative action, such as providing us with a CV or a cover letter containing such data);
    • the conclusion and subsequent performance of a contract with you (on the basis of Article 6(1)(b) GDPR), that is, in particular, data to be entered in the content of the contract to be concluded in the event of a successful recruitment outcome;
    • arising from the legitimate interests pursued by the Data Controller (Article 6(1)(f) GDPR), i.e.:
      • – to select a suitable candidate who gives the guarantee of proper performance of assigned duties, that is, data collected by us in the course of recruitment activities, e.g. in notes made during interviews with you,
      • – to assert and defend against claims, in and out of courts and administrative bodies (for all data collected),
      • -archiving and backing up of the data in its possession, in connection with the obligation imposed on the Data Controller to properly secure the data (to the extent of all data collected);
    • informing you about future job offers and contact you about future recruitment processes – based on the consent you have given (Article 6(1)(a) GDPR),
    • in the case of the use of a recruitment form on our website – for the purpose of concluding and performing a contract for the provision of electronic services relating to this form, based on the necessity of the processing for the performance of the contract (Article 6(1)(b) of the GDPR).
  4. In the case of recruitment in connection with employment under an employment contract, the provision of personal data referred to in the provisions of the Labor Code is a statutory requirement, and their failure to do so will result in the inability to consider the candidate’s application for the offered position. Provision of personal data in a broader scope is voluntary (on the basis of consent) and will not affect the possibility of participation in the recruitment and consideration of the candidate’s offer.
  5. In the case of recruitment in connection with employment based on a civil law contract, providing the data is a condition for participation in the recruitment process and possible conclusion of the contract and at the same time its requirement. The consequence of failure to provide the required data will be the Data Controller’s inability to include the candidate in the recruitment process..

HOW LONG DO WE PROCESS PERSONAL DATA?

Your personal data will be processed:

  1. to contact you – from the date of their collection and for as long as we can reasonably be expected to continue the conversation,
  2. for marketing purposes – (i) in the case of marketing based on our legitimate interest – for the duration of our legitimate interest, i.e. the duration of the relationship between us or until you raise an objection, but no longer than until you effectively raise an objection; (ii) in the case of marketing based on your consent – until you withdraw your consent.;
  3. for the purpose of sending you the Newsletter – for the duration of your subscription, until you unsubscribe from the Newsletter,
  4. for recruitment-related purposes: (i) until the Data Controller completes the verification of your application and informs you of the results of the recruitment process, but no longer than until the end of the process – if you do not give your consent for the Data Controller to further process your data for future recruitment, (ii) for a period of 2 years from the moment you deliver your data to the Data Controller or until you withdraw your consent for their processing – if you give your consent for the Data Controller to further process your data for future recruitment processes;
  5. for the purpose of investigating and defending against claims – for a period no longer than the period of the statute of limitations for claims;
  6. in order to comply with obligations imposed by law – for a period no longer than necessary to demonstrate that these obligations have been fulfilled by KWKR;
  7. to improve the operation and security of our the website for as long as the data are necessary for this purpose, but no longer than until you express an effective objection to their processing
  8. for archiving and backup purposes – for the period determined in accordance with the backup and archiving policy of the KWKR;
  9. for the purpose of execution and settlement of contracts concluded with Suppliers and Contractors – for the period of execution and settlement of the contract, including the period of claim and storage of documentation concerning the performance of obligations imposed by law;
  10. for the purpose of establishing and maintaining business relationships with Suppliers and Contractors – for the duration of such relationships;
  11. in connection with the use of our social media – for the period related to the fulfillment of the processing purposes indicated above in accordance with our retention policy, whereby information within the posted comments will be available on the respective website until deleted by the author, and statistical data on visitors to our social media websites will be processed for no longer than the period of availability of such data on the websites,
  12. on the basis of your consent – until it is withdrawn, but this does not affect the correctness of the Data Controller’s processing of personal data prior to its withdrawal,
  13. based on the legitimate interest of KWKR – for the duration of this interest, but no longer than until you make an effective objection to such processing.

We exercise due diligence in selecting the entities to which we transfer your data; we require these entities to protect your data with appropriate technical and organizational measures. Your personal data may only be disclosed to:

  1. to third parties providing services to us that are necessary to fulfill the purposes for which we process your personal data (e.g., IT services, recruitment, electronic communications, hosting, inbound marketing, improving sales and customer service);
  2. to recipients to whom the data must be disclosed under applicable law or a decision of a court or other authority;
  3. to other recipients if you consent to disclose the data to them or if the transfer of the data to them is necessary to protect your vital interests or those of other individuals or for the common good.

Google

We use Google Analytics, a web analytics service offered by Google that tracks and reports information about Website traffic. This information is then shared with Google, which may use it to contextualize and personalize ads. Meta (formerly Facebook)

We use the Meta Pixel provided by the social network Facebook, operated by Meta Platforms, Inc., 1 Hacker Way, Menlo Park, CA 94025, USA, or if you are an EU resident, by Meta Platforms Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (hereafter “Meta”).
